Drama In My Life - BEFORE PICS - PART 3

My vocabulary, spelling and grammar leave much to be desired. Please forgive me. BUT, I AM very good at finances and I'm very STUBBORN!

The reason I decide to buy the house that I did, was because it had everything I wanted. I preferred a house with at least an acre with trees and most importantly, I wanted absolute seclusion. Just as soon as I bought this house, I had a 7 ft. rock fence built all around the back yard and a 10 ft. rod iron fence made for the front yard.

I had a 20 by 40 ft. garage built in the back of this acre. I bought about 14 large pecan trees. I then started picking up stray dogs that I knew nobody wanted. I knew they would live safely in a big yard filled with trees and grass. I was so happy and so were my dogs.

I live in an arid region and the only way for my big yard to continue having its beautiful trees and green grass is through irrigation.

When I bought this house, the past owner had sold those rights to the city with an option of getting those rights back after 25 years. What he had been doing in order water the property was to rent those rights from the city. He decided to sell his house and I bought it.

For a year, I continued getting the irrigation water, every 2 weeks, starting from March to September, which would flood my entire acre. A little over a year ago, they decided that I could not rent this water anymore. At this point, it had already been 25 years that the past owner had sold the rights back to the city.

I received in the mail a copy of the notarized contract letter from the water company which showed that they had already renewed the contract again to keep the irrigation rights for themselves.

I called immediately and told them they had never sent me the certified letter they were suppose to send me, 30 DAYS BEFORE THEY RENEWED THE CONTRACT. They told me that they HAD sent that prior certified letter to me. I told them that they had not and I wanted the copy of that certified letter they said they had sent me. They said they'd have to look for it and would call me back. They never did and continued to ignored me for a full year as I CONTINUED to go and demand the COPY of the contract they SAID they had sent me. Let me say here that the woman I had to deal with was the most barbarically RUDE woman I'd ever encountered!

I tried without success to find an attorney who would represent me. I stressed to each and every one of them that I didn't want any freebies and that I was willing to pay whatever they charged for their services. I even had one attorney hang up on me when I explained exactly what I wanted and that it had to do with the city.

This summer, I had little wells dug around each tree and shrubs and started watering with my watering hose each tree (NO GRASS) with a little water because they were dying. When I got my water bill for that month, it was for almost $800.00. I nearly had an attack and started crying. It was now impossible for me to save my trees. I had to get a loan in order to pay for that astronomical bill.

How beautiful. I don't even want to know what it looks like now although I can imagine, being from that area myself. The city and county governments of that area are run by a bunch of assholes.

i'm so sorry...:(
when i was finishing law school i was told many times to specialize in water rights. in CA it is and will continue to be a somber and critical part of life and law. where you live it is even more critical.
the owner of the 'rights' must always have a definitive contract that can be revocable and/or determinatively non-renewable. sounds (by what you've said to date) that the owner of the rights was making the argument that there could be no assignment of the property. my first read is that the 'rights' run with the land and the property you own has the rights to the water. at least that's how it works in CA.
what a beautiful oasis before the 'district' revoked the contractual responsibilities. you weren't offered the right to 'take back' and on its face appears to be a legal wrong!

I don't know what to say. I have no words of encouragement as I see nothing encouraging about your situation. Have you tried looking at a national trial lawyers list? Maybe you could find someone out of town to represent you. Know that you are in my prayers...

I don't understand what a lawyer would not take on the case.

water rights .. definitely a HUGE issue ..

That kind of lawyer is called a real estate lawyer and he works only for the BIG guys. They don't want to waste their time on the little people like myself. So sad.

If your after photos are going to look like I think they are going to look, I don't blame you for getting enraged.

It seems ot me if the Company renewed the contract with you they would have had to pay you for those water rights again. Therefore there must be some record of transaction of money. Maybe I have it wrong, but tdhere are two things that make a contract binding, one is your signature, the other is an exchange of money.

The man who I bought the house from a couple of years ago, is the one who sold those water rights 25 years ago.

I, the new owner, was supposed to receive a certified letter, 30 days BEFORE, letting me know of their intent. They never sent me such a letter.

The AFTER pics will be posted in a little while. Yes, this pics break my heart.

I plan to read back more as soon as I can, but I wanted to let ya know that I do care enough to try. Sorry things are going so arduously for ya right now, and I hope they will straighten out...and faster than the buerocracy, at that.

OMG! I know how you feel, and I feel the same way everytime I pass the neighborhood where my two town homes are. And, I ESPECIALLY hate it when I have to go clean the pool. uhh... the grief!

Don't you just hate it when people use their influence to infringe on the rights of others? I mean seriously, what makes people think that they have the right to mess with people's livelihood like this? And, all because of money! Money which in turn they throw at the government to get away with it too.

Let's go shoot some people! Only if we could, right? Sometimes it would just be a lot easier that way. :P

It's beautiful land. Good luck in Court.

The background in my livejournal is the place where I grew up. Morton Salt mined under our land and didn't have mineral rights. We didn't even know they were under us till our foundation started to crack. We took them to court and the judge decided they owed us $96,000 Which the judge said was fair market value (this was in 97) We had 33 acres, only 6 are really shown in the picture... 33 acres and a house, and that's all we got was $96,000. The judge didn't even take into account the value of the salt that they took from us and sold.

We were forced to move from property that had been in our family since the turn of the century. I hope you have better luck.
